This section is dedicated to and mainly concerns the important update regarding the Data Protection Law and our privacy policy, which entered into force on 1 September 2023.

This law strengthens people's self-determination regarding their data, forcing those who obtain and process personal data to increase transparency and increasing people's rights.
 
For Flo-Homecare your privacy is a priority and we would like to reassure you that we will continue to treat your personal data with the utmost respect and attention, in full compliance with the new legislation.

Flo-Homecare undertakes to treat all confidential information as strictly confidential. You may make confidential information available to third parties only with the prior written consent of the customer/patient.
Flo-Homecare undertakes not to use confidential information for purposes other than those mentioned in the preamble.
Flo-Homecare undertakes to take all necessary precautions to prevent unauthorized persons from accessing confidential information.
Flo-Homecare undertakes to make confidential information accessible only to employees who need it for the fulfillment of the purpose mentioned in the preamble and who are bound to secrecy in writing and for an unlimited period both during the current employment relationship and after its termination.
Flo-Homecare undertakes to return in full or to destroy, at the first request of the customer / patient and at your discretion, all documents and data carriers that have been provided to it and which contain confidential information, as well as copies that have been made of them.
Flo-Homecare waives any existing right of retention or lien, regardless of legal reasons. The completeness of delivery or destruction must be confirmed in writing.
Flo-Homecare must immediately notify the customer of any data security breach. To the extent possible, Flo-Homecare will provide the following information in the relevant notification:
• the nature of the data breach;
• as far as possible the date, time and duration;
• as far as possible, the categories and approximate number of personal data involved;
• the consequences of the data security breach, including any risks to the patients involved;
• the measures applied or envisaged to remedy the defect and to reduce its consequences, including any risks, as well as the names and contact details of a person of If Flo-Homecare becomes aware of any of the above information in a following moment, will inform the customer without delay. Furthermore, Flo-Homecare will provide the customer with all information relating to the data security breach without delay and upon the customer's first request.

 

Appointments not canceled at least 24 hours in advance will be charged to your account (CHF 50). Please inform us in time.

Patient information on the processing of personal data
Below, we inform you about the purposes for which Flo-Homecare collects, stores or transmits your personal data. Furthermore, Flo-Homecare informs you of your rights, which you can exercise in the area of data protection.

The person responsible for the processing of your personal data and in particular your health data is Flo-Homecare.

If you have any questions about data protection or would like to exercise your data protection rights, please contact Flo-Homecare directly.

The processing (collection, storage, use and storage) of your data is carried out on the basis of the processing contract and the legal requirements for the fulfillment of the purpose of the processing and the associated obligations. On the one hand, data is collected by Flo-Homecare in the course of the treatment. On the other hand, we also receive data from other health professionals with whom you have been or are being treated, if you have given your consent. Only data relating to your medical treatment are processed in your medical history. The medical history includes the personal information provided in the patient form, such as biographical data, contact data and insurance data, as well as, among other things, the educational interview conducted as part of the treatment, the health data collected such as the medical history, diagnoses, therapy proposals and results.

Your medical records will be kept for years after your last treatment. Afterwards, with your explicit consent, it will be stored or deleted or destroyed in a secure manner.

We transfer your personal data, and in particular your medical data, to external third parties only if this is permitted or required by law or if you have consented to the transfer of data as part of your processing
The data is transferred to your health insurance, accident insurance or disability insurance for the purpose of billing the services provided to you. The type of data transmitted is based on legal requirements.

 

The information is transmitted to cantonal and national authorities (e.g. cantonal medical service, health departments, etc.) on the basis of the notification obligations required by law.
The necessary patient and invoice data are transmitted to the collection agency for collection purposes (collection of owed monetary claims). In individual cases, depending on your processing and your corresponding consent, the data are transferred to other authorized recipients (for example laboratories or other health professionals).
If you have given your explicit consent to the processing of your data, you can revoke it in whole or in part at any time. The revocation or request for modification of consent must be made in writing. As soon as Flo-Homecare has received your written revocation and the processing cannot be based on any other legal basis other than consent, the processing will be stopped.
The legitimacy of the data processing carried out until the revocation remains unchanged by the revocation itself.
You have the right to obtain information about your personal data at any time. You can consult your health history or even request a copy. Providing a copy may incur a charge. You will be informed in advance of any costs, which depend on the time and effort required to make the copy.
You have the right to have the data processed by the nurse automatically or digitally delivered to you or to a third party, in a common, machine-readable format. This applies in particular to the transfer of medical data to a healthcare professional of your choice. If you request the direct transfer of data to another responsible person, this will only happen to the extent that it is technically possible.
If you discover or believe that your data is incorrect or incomplete, you have the opportunity to request a correction. If it is not possible to establish either the correctness or incompleteness of your data, you have the option of attaching a notice of dispute.
